Slavery, Sex & Gender, and the Ancient Doctrine of Stare Decisis: A Re-Examination of the Doctrine in Light of Time Influenced Legal Reasoning and the Current State of Transgender Legal Issues

MEISELMAN, ALYSON DODI U.S.A.
Co-author: Phyllis Randolph Frye (U.S.A.)

Attorneys Meiselman and Frye will present segments of their jointly published law review article, by the same name, as can be found in the Georgetown Journal of Gender and the Law.

Specifically, Attorneys Meiselman and Frye will address the following transgender concerns and legal issues: 1) the doctrine of judicial precedence in determination of current cases before the courts; 2) the impact of expert medical testimony in court proceedings where the legal sexual identity of a part is at issue; 3) the extension of the Corbett decision in Texas, the growth of the Litteton decision into other States, and, in the ability of third parties to attack marriage where a party to the marriage is transsexual; 4) what preparation the health care (medical, psychological, and social) community must do before presenting testimony to assist patients in court proceeding to legally change their identity or attack the patient’s new identity.
